Friday March 29, 2013 - The Attorney General Githu Muigai yesterday faulted the constitution with its legal terms like ‘fresh election’ should the Supreme Court rule in favour of the petitioner, Prime Minister Raila Odinga.

In his amicus curiae brief, Muigai whose statement seemed skewed in favour of the President elect Uhuru Kenyatta cautioned the Supreme Court of the possible constitutional crisis should it invalidate the March 4th Presidential elections saying the constitution was not clear on fresh elections.

He noted that some articles in the constitution were inconsistent with one another as to whether fresh elections would entail the entire electoral process from the primaries or would limit certain candidates.

He also cautioned the ramification of the Supreme Court ruling should it declare the IEBC voters register as having substantial defects saying the other elected office holders like his friend  Busia Senator Wako, other Senators, Governors MPs and all others will have to vacate the office because they were elected using the same register.

He appealed to the court to exercise caution and wisdom while delivering the verdict.
